1. Acceptance

By creating an account or using Witness Labs (the "Service"), you agree to these Terms & Conditions. If you do not agree, do not use the Service. These Terms form a binding agreement between you and WITNESS AI, headquartered in Pune, Maharashtra, India.

2. The Service

Witness Labs is an AI-assisted creative prompt engineering workstation. It helps users author high-precision prompts for image and video generation models across multiple creative verticals including editorial fashion, automotive, poster design, and general visual synthesis. Certain features rely on third-party AI models (including Google Gemini and Midjourney-compatible prompt formats).

3. Eligibility & Accounts

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• One account per person. Sharing accounts is not permitted.

4. Credits, Plans & Payment

Access to the Service is metered in credits. Credits are consumed on each generation according to the model and mode used. Plans and top-up packs are available at published prices in Indian Rupees (INR) plus applicable taxes.

• Payment is processed by our payment partners; we do not store card details.
• Prices may change; existing subscriptions honour the price at renewal notice.
• Refunds are governed by our Refund & Cancellation Policy.

5. Acceptable Use

You agree not to use the Service to generate, distribute, or attempt to generate:

• Content that is illegal under Indian law or the law of your jurisdiction.
• Sexually explicit content involving minors, or non-consensual intimate imagery.
• Content that incites violence, hatred, or discrimination.
• Content that infringes third-party intellectual property, trademarks, or personality rights.
• Malware, phishing content, or material designed to defraud.
• Content that violates the acceptable-use policy of any upstream model provider.

We may suspend or terminate accounts that violate this section without refund.

6. Intellectual Property

• Your prompts and outputs. You retain ownership of the prompt text you author. Rights in AI-generated outputs are subject to the terms of the underlying model provider and applicable law.
• Our platform. The Witness Labs application, brand, design system, prompt templates, knowledge bases, and specialist reasoning modules are the exclusive property of WITNESS AI. You may not copy, reverse-engineer, or resell them.
• Feedback. If you submit suggestions or feedback, you grant us a perpetual, royalty-free licence to use it to improve the Service.

7. Third-Party Services

The Service integrates with third parties including Google (authentication and Gemini models), Supabase (data infrastructure), and payment gateways. Your use of those services through Witness Labs is also subject to their respective terms and privacy policies.

8. Availability & Changes

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. Material changes will be communicated in advance where reasonably possible.

9. Termination

You may close your account at any time from your dashboard or by contacting support. We may suspend or terminate your account for material breach of these Terms. On termination, unused credits may be forfeited unless a refund is due under the Refund Policy.

10. Disclaimers

The Service is provided "as is" and "as available". We make no warranties as to fitness for a particular purpose, accuracy of AI outputs, or non-infringement. You are responsible for reviewing outputs before commercial use.

11. Limitation of Liability

To the maximum extent permitted by law, WITNESS AI's aggregate liability arising from your use of the Service is limited to the amounts you paid to us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

12. Indemnity

You agree to indemnify and hold WITNESS AI harmless from any claim arising out of your use of the Service, your content, or your breach of these Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of Pune, India.

14. Changes to These Terms

We may update these Terms. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
